Findings: <br /> Application of the proposed optimized haul truck operating parameters in Mitigation Measure <br /> 3.4.1 would be expected to effectively mitigate project-related noise exposure from the <br /> perspective of the applicable County noise exposure level criteria and noire exposure level <br /> increase criteria(as described by the L&d. However, application of the optimized haul truck <br /> operating parameters may not fully mitigate the significant increase in probability of residential <br /> awakenings due to project haul truck operations (single-event noise). Due to the significant <br /> increase in probability of residential awakenings in the project area due to project haul truck <br /> passbys, this impact is considered significant and unavoidable. See Final FIR,pp. 3.4-16 to <br /> 3.4-17. <br /> DA. OTHER CEQA REQUIRED ANALYSIS IN THE EIR <br /> Cumulative Impact Anal <br /> Cumulative impacts are defined in State CEQA Guidelines §I5355(b) as: <br /> The change in the environment which results from the incremental impact of the project when <br /> added to other closely related past,present, and probable future projects. Cumulative impacts can <br /> result from individually minor but collectively significant projects taking place over a period of <br /> time. <br /> Due to the nature of this project, the potential change to the environment is related to the change <br /> in operating hours, rather than a change in land use or a physical change to the project site. <br /> Therefore, a cumulative effect would result from interaction with other projects that would affect <br /> the same environmental resources during the same time period. The"cumulative setting" <br /> includes other projects either with night-time operations or 24 hour operations. Such uses could <br /> include industrial, 24-hour retail, or large residential projects that could be expected to create <br /> night time activity. <br /> The project area consists of agricultural land uses (primarily orchards). Other land uses in the <br /> area include existing rural residences on agriculturally zoned land. Like the project site, all the <br /> parcels surrounding the site are zoned AG-40 (40 acre minimum)with a General Plan <br /> Designation of General Agriculture(AG). The project applicant also owns and operates a sand <br /> quarry northeast of the project site on the north side of E. River Road. This sand quarry would <br /> not be involved in the proposed nighttime operations. <br /> There are no proposed or approved development projects in the area. In addition, there are no <br /> past projects which would create additional night time effects that have not been accounted for in <br /> the existing project setting. <br /> Findings: <br /> Based on the information above, and the whole of the Record, the Commission finds that there <br /> are no significant cumulative effects associated with the Proposed Project. <br /> 11 <br />
