significant effects which are identified in the final EIR but are not avoided or <br /> substantially lessened,the agency shall state in writing the specific reasons to support its <br /> action based on the final EIR and/or other information in the record. The statement of <br /> overriding considerations shall be supported by substantial evidence in the record. <br /> (c) If an agency makes a statement of overriding considerations, the statement should be <br /> included in the record of the project approval and should be mentioned in the notice of <br /> determination. This statement does not substitute for, and shall be in addition to, findings <br /> required pursuant to Section 15091. <br /> This section provides the findings in reliance on the whole Record including the Final EIR, <br /> Section F above Project Benefits, its references and the documents attached to these findings. <br /> The Commission finds that the previously stated benefits(Section F "Project Benefits") of the <br /> Munn&Perkins Quarry Excavation Permit as contained in the proposed action and described <br /> herein, outweigh the two unavoidable significant adverse environmental impacts as discussed in <br /> Section D.3. The benefits of the Project, as cited herein, are hereby determined to be, in <br /> themselves and independently of the other project benefits, a basis for overriding all significant <br /> and unavoidable and cumulative environmental impacts identified in the EIR and in these <br /> findings. <br /> The Commission finds that: <br /> 1. All freeway, state highways, and local roads and streets in the Service Area <br /> require periodic reconstruction replacement,and repaving. <br /> 2. There are three freeways, several state highways and many local streets and roads <br /> in the Service Area which periodically require reconstruction replacement, and repaving. <br /> 3. The Service Area is a large heavily populated area including Manteca, Ripon, <br /> Escalon, Riverbank, and parts of Lathrop, Stockton, and Modesto as well as populated <br /> unincorporated areas. <br /> 4. Federal and State funding for freeways, state highways, and local roads and <br /> streets has greatly decreased. Much roadway work in San Joaquin County is made <br /> possible, even on freeways and state highways,by the sales tax paid by the people of San <br /> Joaquin County to the San Joaquin Council of Governments which in turn distributes the <br /> money to freeway and state highway projects either as advances or as a partner as well as <br /> for local streets and roads. Longer hauls mean a substantially higher cost which uses up <br /> Rinds of the San Joaquin County's sales tax payers without producing more and better <br /> roadways. <br /> 5. Within the Service Area there has been a substantial increase of traffic, traffic <br /> congestion complaints, as well as a concern for CalTrans/Construction workers safety. <br /> Maintenance and construction specifications stipulate that much of the delivery of asphalt <br /> in must occur at night, as necessary, to reduce interference with congested traffic and <br /> commuter traffic Caltrans has increased it reliance on nighttime projects. <br /> 22 <br />
