PC: 10-15-92 <br /> MS-92-133 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> This Minor Subdivision application which would normally be processed by staff under Staff Review with <br /> Notification procedures, has been placed on the Planning Commission's agenda as a result of seven <br /> letters in opposition received from property owners in the vicinity of the project site. The bases for the <br /> opposition are discussed in the staff report under'Neighborhood Opposition.' Copies of these letters are <br /> included in the staff report as Attachment A. <br /> POLICY CONSIDERATIONS: <br /> General Plan and Zoning: <br /> This application is being processed under the provisions of the 1995 General Plan. The site is <br /> designated on the Land Use/Circulation Element Map as Agriculture. The project's zone <br /> designation of AG-40 (General Agricufture; 40-acre minimum parcel size) is a compatible <br /> implementing zone for the Agriculture General Plan designation. Provisions for the creation of <br /> owner-operator homesite parcels are contained in Section 9-4010.2{a} of the Planning Title. <br /> The site's designation under the 2010 General Plan is A/G (General Agriculture) with a consistent <br /> implementing zone of AG-80 (General Agriculture; 80-acre minimum parcel size). Section 9-610.3 <br /> of the Development Title contains provisions for the creation of homesite parcels. With the <br /> exception of the homesite parcel, this application could not be processed under the provisions <br /> of the Development Title due to its inconsistency with the 80-acre minimum parcel size <br /> requirement. <br /> Prior to the submittal of the application, the owner indicated to staff his desire to divide his <br /> property into three 40-acre parcels and to create an owner-operator homesite parcel for himself <br /> from one of the 40-acre parcels. Rather than require the owner to submit two applications for a <br /> Minor Subdivision, it was determined that one application could be processed, showing both the <br /> two 40-acre parcels and the homesite parcel. The 30-acre parcel shown on the tentative parcel <br /> map reflects the remaining acreage after the creation of a 10-acre owner-operator homesite parcel <br /> from one of the two 40-acre parcels. <br /> AREA/NEIGHBORHOOD COMPATIBILITY: <br /> Land Use: <br /> The project site, containing a residence, a cattle feed lot, accessory agricultural buildings, and <br /> grain crops, is surrounded by agricultural uses in all directions, with scattered residential uses in <br /> the area The existing residence on the remainder is occupied by a tenant. The owner's mother <br /> lives in a residence on a separate parcel to the north of the remainder parcel's structures. Neither <br /> the subdivision of the property nor the construction of additional residences on the resultant <br /> parcels is expected to result in any significant, adverse conflicts with either the surrounding <br /> agricultural or residential uses. <br /> -8- <br />
