7 <br /> 1 <br /> Payment of compensation for the performance of extra services shall be made by <br /> COUNTY to CONSULTANT in the manner determined by the County Director of <br /> Community Development. <br /> Payment for the extra services include a maximum contingency of twenty percent <br /> (20%) of the "Payment Amount" shown on page 4 of-this agreement. The total <br /> payments made for services performed pursuant to this Agreement (including the <br /> extra services) shall not exceed Four-hundred eighty-four thousand, four- <br /> hundred and thirty dollars and forty cents ($484,430.40). <br /> 4. Data to be Furnished <br /> A. All information, data, reports, records, and maps as are existing, available <br /> and necessary for the carrying out of the services as set forth in this <br /> Agreement, shall be furnished to CONSULTANT. CONSULTANT agrees <br /> that COUNTY'S responsibility to furnish information is limited to data of <br /> record and in format as recorded. No special studies or research will be <br /> undertaken by COUNTY. <br /> B. CONSULTANT shall furnish the following number of copies of reports to the <br /> COUNTY: <br /> Administrative Draft Environmental Impact Report : 10 and one electronic <br /> copy <br /> Draft Environmental Impact Report: 35 and one electronic copy <br /> Administrative Final Environmental Impact Report : 10 and one electronic <br /> copy <br /> Final Environmental Impact Report: 35 and one electronic copy <br /> C. CONSULTANT shall submit all requests for data and/or reports to the <br /> .Director of Community Development for disposition. The Consultant shall <br /> submit all materials directly to the County Director of Community <br /> Development for review prior to making the materials available to the project <br /> applicant or other interested parties. <br /> D. Upon completion of work or termination of this Agreement, all reports <br /> including the masters of the Draft and Final Environmental Impact Reports <br /> and pertinent data or materials related to this Agreement shall become <br /> property of COUNTY and shall be delivered to COUNTY forthwith and prior <br /> to final payment by COUNTY to CONSULTANT. CONSULTANT shall give <br /> the masters of the Draft, and Final Environmental Impact Reports to <br /> COUNTY. CONSULTANT shall have the right to retain copies of <br /> documents delivered to COUNTY. <br /> 3of9 <br />
