While agricultural land is generally a suboptimal habitat for <br /> many plants and animals, several sensitive species have either adapted to this <br /> land use or exist along its margins,waterways and drainage features. We <br /> have identified the following species of concern, given the agricultural <br /> landscape and those species known to occur within the project's USGS <br /> Quadrangle.These are: <br /> • burrowing owl <br /> ' <br /> S <br /> 0 wainsons hawk <br /> s - <br /> • valley elderberry longhorn beetle <br /> • California tiger salamander <br /> • giant garter snake <br /> • tricolored blackbird <br /> • vernal pool fairy shrimp <br /> • pallid bat <br /> For example, the nearest named creek(Lone Tree Creek),about three miles <br /> northeast of the site,supports habitat for the giant garter snake;burrowing owls <br /> are known to use berms around agricultural fields and are possible residents <br /> within the project area(the species occurs Sharpe Army Depot to the west); <br /> Swainson's hawks utilize agricultural fields for foraging and isolated trees <br /> e.g.,along roads for nesting,and are relatively common in the area. <br /> The role of the San Joaquin County Multi-Species Habitat <br /> Conservation Plan (MSHCP) <br /> The USFWS, in their August 23 comment letter on the NOP,recommended <br /> that UPRR participate in the MSHCP,or, alternatively,demonstrate equivalent <br /> avoidance and minimization measures for listed species.The decision whether <br /> or not to participate should be made at the start of the CEQA process(in <br /> San Joaquin County—E!R for the Union Pacific Modemization Project 1-17 <br />
