Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Certify as adequate Final Environmental Impact Report No. PA-0900185 under the provisions of <br /> Section 15090 of the California Environmental Quality Act(CEQA) (Attachment A). <br /> 2. Adopt"Findings of Significant Environmental Impacts" (Attachment B). <br /> 3. Adopt"Statement of Overriding Considerations" (Attachment B). <br /> 4. Adopt the "Mitigation Monitoring Program" (Attachment C). <br /> 5. Approve Use Permit Application No. PA-0900184 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> Master Plan, Specific Plan, and any other applicable plan adopted by the County. <br /> • This finding can be made because the proposed expansion of the Union Pacific Intermodal <br /> Facility is consistent with all relevant General Plan Policies (see pg. 4.1-9 in the Draft EIR for <br /> an analysis). The Conditions of Approval ensure that the facility will operate and interact <br /> with the surrounding community in a compatible manner, consistent with the policies and <br /> implementation measures contained in the General Plan. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because an on-site septic system approved and inspected by the <br /> Environmental Health Department will be provided. On-site storm water retention ponds will <br /> also be provided and reviewed by the Department of Public Works. The City of Lathrop will <br /> continue to provide water services. Additionally, the Conditions of Approval will include <br /> traffic mitigation measures as identified in Section 4.2 of the Draft EIR to lessen traffic <br /> impacts. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the subject parcels are of adequate size and shape to <br /> accommodate the proposed intermodal facility expansion and all yards, building coverage, <br /> setbacks, parking areas, and other requirements of the Development Title. The Site Plan <br /> shows that there is sufficient area for parking and circulation for the intermodal facility in <br /> compliance with Standards of the Development Title. <br /> 4.
