Projects within 1 mile of an active nest tree shall provide: i <br /> I. One acre of HM land for each acre of development authorized(1:1 <br /> ratio).At least 10 percent of the HM land requirements shall be met by <br /> fee title acquisition or a conservation easement allowing for the active <br /> management of the habitat,with the remaining 90 percent of the HM I <br /> lands protected by a conservation easement[acceptable to the CDFG] <br /> on agricultural lands or other suitable habitats that provide foraging <br /> habitat forSwainson's hawk);or <br /> ii. One-halt acre of HM land for each acre of development authorized , <br /> (0.5:1 ratio).All of the HM land requirements shall be met by fee title <br /> acquisition or a conservation easement[acceptable to the CDFG] <br /> which allows for the active management of the habitat for prey <br /> production on the HM lands). <br /> b. Projects within 5 miles of an active nest tree but greater than 1 mile from <br /> the nest tree shall provide 0.75 acre of HM land for each acre of <br /> development authorized(0.75:1 ratio).All HM lands protected under this <br /> requirement may be protected through fee title acquisition or <br /> conservation easement(acceptable to the CDFG)on agricultural lands <br /> or other suitable habitats which provide foraging habitat for Swainson's <br /> hawk. <br /> c. Projects within 10 miles of an active nest tree but greater than 5 miles <br /> from an active nest tree shall provide 0.5 acre of HM land for each acre <br /> of urban development authorized(0.5:1 ratio).All HM lands protected <br /> under this requirement may be protected through fee title acquisition or <br /> a conservation easement(acceptable to the CDFG)on agricultural lands <br /> or other suitable habitats which provide foraging habitat for Swainspn's <br /> hawk. <br /> 3. As an alternative to providing FIM land for mitigation for the loss of foraging <br /> habitat as set forth in paragraph 2 above,the applicant may participate in <br /> the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan("SJMSCP").The SJMSCP provides a conservation strategy <br /> aimed to minimize,avoid,and mitigate impacts on features that include but <br /> are not limited to special-status species,wetlands,and other waters found <br /> within San Joaquin County.With regard to species,the SJMSCP <br /> conservation strategy is habitat-based and emphasizes compensation for <br /> habitat losses through the establishment,enhancement,and management- <br /> in-perpetuity of preserves. <br /> 7777777 <br /> r��,�(gtoglcaARe$ogrces(cont} ..
