Subsequent Discretionary Approvals and to comply with legal requirements and policies of the <br /> County pertaining to such Existing Approvals and Subsequent Discretionary Approvals. <br /> 2.2.5. Notwithstanding anything to the contrary in this Section 2.2., if any of the <br /> events described in Public Resources Code Section 21166 (as that Section may be amended from <br /> time to time) have occurred or would occur in connection with an amendment to an Existing <br /> Approval or an application for a Subsequent Discretionary Approval, the County shall require <br /> preparation of a subsequent Environmental Impact Report("Subsequent EIR") or a supplement <br /> to the Project EIR under either CEQA Guidelines Section 15162(a) or Section 15163(a) (as these <br /> Sections may be amended from time to time), as applicable. <br /> 2.3. Development Phasing and Timing. <br /> 2.3.1. The Developer shall have until expiration of the Term of this Agreement <br /> in which to secure and satisfy any Existing Approvals, Approvals, Development Permits or <br /> Subsequent Discretionary Approvals in connection with the development of the Property, <br /> including compliance with any conditions of approval therein, the securing of all necessary or <br /> desirable building permits and the securing of and compliance with any necessary or desirable <br /> Subsequent Discretionary Approvals, Approvals and Development Permits from Other <br /> Governmental Agencies, and each Existing Approval, Approval, Development Permit or <br /> Subsequent Discretionary Approval issued in connection with the development of the Property <br /> shall so provide. The Use Permit is hereby amended by this Agreement to provide that the <br /> Approvals granted therein shall not expire until expiration of the Term of this Agreement, and <br /> the Developer shall have until the expiration of the Term of this Agreement in which to satisfy <br /> all conditions of approval therein, to secure all necessary or desirable Development Permits, <br /> including building permits, and to secure all necessary or desirable Approvals, Development <br /> Permits and Subsequent Discretionary Approvals from Other Governmental Agencies in <br /> connection with the Project, as the Project is currently described in the Use Permit or as the <br /> Project may be amended from time to time. Specifically, the Developer shall have until the <br /> expiration of the Term of this Agreement in which to satisfy all conditions of approval within the <br /> Use Permit, as the Use Permit may be amended from time to time, to secure all necessary or <br /> desirable Development Permits, including building permits, and to secure all necessary or <br /> desirable Approvals, Development Permits and Subsequent Discretionary Approvals from Other <br /> Governmental Agencies: (i) in connection with"Phase One" and "Phase Two" of the Project as <br /> described in the Use Permit, or(ii) in connection with the Project as the Project may be revised <br /> from time to time, including as the phasing plan for the Project may be revised. <br /> 2.3.2. The Developer may revise the phasing of the Project under the Use Permit <br /> without the need for obtaining any Subsequent Discretionary Approvals or further Approvals or <br /> Development Permits from the County, other than textual changes to the Use Permit to reflect <br /> the revised phasing plan which are approved in form by the Community Development Director, <br /> provided that the revised phasing plan would not otherwise exceed the Approvals granted by the <br /> County under the Use Permit, as amended by this Agreement, and none of the events described <br /> in Public Resources Code Section 2166 (as that Section may be amended from time to time) have <br /> occurred or would occur. Any revised phasing plan proposed by the Developer which would <br /> exceed the Approvals granted in the Use Permit, as amended by this Agreement, shall be <br /> reviewed by the County as an amendment to the Use Permit or as a Subsequent Discretionary <br /> -21- <br />
