Negative <br /> Declaration and Reclamation Plan <br /> Dear Mr. Luoma: <br /> The Department of Conservation's Office of Mine Reclamation (Office) has <br /> reviewed the Application Referral for a Negative Declaration for Aggregates Inc. <br /> Reclamation Plan. The Office is responsible for the statewide administration of the <br /> 1975 Surface Mining and Reclamation Act (SMARA). The Office's Catherine Gaggini <br /> and Karen Wiese prepared the following comments to assist in your review of this <br /> project. <br /> The open-pit aggregate mine is located west of Santa Fe Road, on the east side <br /> of Henry Road, 3600 feet north of the Stanislaus River in Escalon. After 10 years of <br /> operation, the 78-acre mine site will be reclaimed for an agricultural end use. SMARA <br /> and the State Mining and Geology Board regulations for surface mining and <br /> reclamation practice require that specific items be addressed or included in reclamation <br /> plans (California Code of Regulations (CCR) Title 14, Chapter 8, Article 1, Section <br /> 3500 et seq., and Article 9, Section 3700 et seq.; and, Public Resources Code Section <br /> 2710 et seq.). Based on our review, we request that the reclamation plan be <br /> augmented to address the following mandatory items of SMARA. <br /> End Land Use <br /> (Refer to SMARA Section 2772(c)(7) and (c)(8); and, CCR Section 3707 (a) and (c), and 3708). <br /> 1 . The reclamation plan should clarify the end use. According to the plan, the site <br /> will be reclaimed to a "farming capability" but does not provide a revegetation <br /> plan specific to the property (see revegetation comments below). <br />
