Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-0900163 with the Findings, Williamson Act Principles of <br /> Compatibility, and Conditions of Approval contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the establishment, maintenance, expansion, and <br /> continued operation of the kennel does not conflict with the General Plan. The use <br /> proposed in application PA-0900163 is consistent with the A/G General Plan designation <br /> and is a conditionally permitted use with an approved Use Permit in the AG-40 zone. <br /> Development Title Section 9-1810.3 lists Animal Specialty Services: Kennel as one of the <br /> limited uses for property under a Williamson Act contract. There are no Master Plans, <br /> Specific Plans, Special Purpose Plans, or any other applicable Plan in the vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because adequate utilities, access roads, sanitation, drainage <br /> and other necessary facilities have been provided and the proposed improvements are <br /> properly related to existing and proposed streets and highways. All utilities, <br /> improvements, and other facilities are existing or will be provided as reflected in the <br /> approved site plan. Power is supplied by Pacific Gas & Electric. The existing access roads <br /> meet County standards for two-way traffic. A new septic system will be built that will meet <br /> the requirements of the Environmental Health Department. The existing well is of adequate <br /> size to supply water for the expanded project. Any additional storm drainage is required to <br /> remain on site. Storm water may flow to the existing retention basin or a new basin may be <br /> constructed; No improvements were recommended or required for the existing roadways. <br /> 3. The site is physically suitable for the type of development and for the intensity of development <br /> • This Finding can be made because the property involved is of adequate size and shape to <br /> accommodate the proposed use and all yards, building coverage, setbacks, parking areas <br /> and other requirements of this Title. The flat, six-acre project area is part of a 123.61-acre <br /> parcel. The proposed buildings will be constructed on a portion of an existing orchard. All <br /> structures that will contain animals will be a minimum of 40 feet from any property line. <br /> The thirty-eight parking spaces proposed by the applicant is more than the minimum of <br /> thirty-two spaces that are required for the Use Type. <br /> San Joaquin County.
