4 Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because an Initial Study prepared for this project found no
potentially significant environmental impacts.
5. The use is compatible with adjoining land uses
• This finding can be made because with the Conditions of Approval the expansion of the
existing kennel will not interfere with or alter the current uses on adjacent properties. The
surrounding uses are primarily agriculture. There is one residence within one hundred feet
of the property line. That property also has a kennel. The next two nearest residences are
more than 1',100 feet from the project area.
Williamson Act Principles of Compatibility
1. The use will not significantly compromise the long-term productive agricultural capability of the
subject contracted parcel or parcels or on other contracted lands in agricultural preserves.
• This principle can be made because the property has been historically used as vineyard,
orchard, and kennel and makes over $200.00 per acre, per year. The use is an approved
use on contracted land pursuant to Development Title Section 9-1810.3. The kennel
expansion will not significantly compromise other contracted lands in agricultural
preserves.
2. The use will not significantly displace or impair current or reasonably foreseeable agricultural
operations on the subject contracted parcel or parcels or on other contracted lands in agricultural
preserves. Uses that significantly displace agricultural operations on the subject contracted parcel or
parcels may be deemed compatible if they relate directly to the production of commercial agricultural
products on the subject contracted parcel or parcels or neighboring lands, including activities such as
harvesting, processing, or shipping.
• This principle can be made because approval of the kennel will not create premature
development pressure on surrounding agricultural preserves or establish an undesirable
growth inducing precedent that will lead to removal of adjacent agricultural lands for
agricultural"use. The new structures will be constructed on an economically unviable
portion of an existing orchard. The parcel contains the soil types Devries sandy loam, 0 to
2 percent slopes, Tokay fine sandy loam, 0 to 2 percent slopes, and Acampo sandy loam, 0
to 2 percent slopes. The project area is entirely Acampo sandy loam, 0 to 2 percent
slopes. Acampo sandy loam,0 to 2 percent slopes, does not have enough structure to
support the weight of the existing trees. The existing trees are stunted, falling over, and
underproducing.
San Joaquin County PA-0900163\Kahler
Community Development Page 5 _
