PA-0900163 OF ALICIA KAHLER (C/O MIKE SMITH ENGINEERING) (APN: 025-200-05; ADDRESS: 5113 SARGENT ROAD, LODI) This project is a Use Permit application for the expansion of an existing dog kennel from 120 dogs to 180 dogs and 50 cats to be built in four phases over twenty years. Phase 1 includes a new 13,067 square-foot, two-story building for an administrative area, a dog kennel for 20 dogs, and a cat kennel for 50 cats. Phase 2 includes a 3600 square foot kennel for 20 dogs. Phase 3 includes a 3600 square foot kennel for 20 dogs. Phase 4 includes a 700 square foot dog training building. Each phase will also include an outdoor meeting area or exercise yard. The existing kennels, office, grooming shop, and training building encompass 25,811 square feet The project is located on the northwest corner of Sargent Road and Ray Road, west of Lodi. The General Plan designation is General Agriculture (A/G) and Resource Conservation (OS/RC) and the zoning is General Agriculture, 40-acre minimum (AG-40). Williamson Act The Department of Conservation was sent a referral on July 7, 2009 because the property is subject to a Williamson Act contract. The Department of Conservation responded in a memo dated August 5, 2009. The Department of Conservation states, "Pursuant to Government Code Section 51250(c), the Department is notifying San Joaquin County that the Department believes that the existing and planned uses and structures on the property may constitute a material breach of the property's Williamson Act contract." The parcel is zoned AG-40 and the parcel is 123.61 acres in size. Pursuant to Development Title Section 9-1810.3(b), property under contract is limited to certain use types. The proposed use, Animal Specialty Services-Kennel is one of the listed uses. I
