CONDITIONS OF APPROVAL <br /> USE PERMIT UP 88-19 <br /> The infrastructure improvements detailed in these Conditions of <br /> Approval (which are also included in the Services Plan, Exhibit B <br /> of the accompanying Development Agreement for the Safeway, Gateway <br /> Business Park, and Bay Cities truck stop projects) are required to <br /> be constructed and in operation by the time that the County <br /> Community Development Department issues a final Certificate of <br /> Occupancy permit for any structures, with the exception of certain <br /> roadway improvement ; in the Caltrans right of way (see conditions <br /> under "Caltrans" below) . <br /> This approval for the Bay Cities Use Permit only will expire 24 <br /> months from the date of approval unless (1) all Conditions of <br /> Approval have been complied with, (2) all necessary building <br /> permits have been secured and remain in force, and (3) all <br /> necessary permits from other agencies have been secured and remain <br /> in force. Nothing in this requirement shall preclude the <br /> requirements or obligations included in the accompanying <br /> Development Agreement. <br /> In the following conditions, the terms "Bay Cities and other <br /> developers" or "developer" refer to the developers of Bay Cities <br /> truck stop, adjacent Bay Cities industrial area projects, Gateway <br /> business park project and Safeway inc. <br /> 1. PLANNING DIVISION: <br /> Conditions of Approval : <br /> a. The truck stop facility shall be limited to the uses <br /> identified in the staff report. The expansion or <br /> addition of services directed toward the traveling public <br /> shall not be allowed. <br /> b. The developer shall submit architectural plans for review <br /> and approval by the Planning Director. The plans shall <br /> include color schemes as well as building and design <br /> materials. <br /> C. Landscaping shall comply with the landscaping plan <br /> submitted September 26, 1990 with the following <br /> modifications: <br /> (1) Landscaping along Patterson Pass Road and Schulte <br /> Road shall screen the parking lot from the view of <br /> the traveling public through the use of berming and <br /> informal hedges. <br /> (2) The trees adjacent to the california aqueduct and <br /> along the east property line shall be spaced 35 ' on <br /> center. <br />
