The process and criteria for <br /> preparing the PSR and associated environmental documents <br /> is outlii.ed in a Memorandum of Understanding that has <br /> been executed between Caltrans and the County. <br /> Any short term improvements to the Patterson Pass Road/I- <br /> 205 and I-580 interchanges and main line facilities which <br /> are identified in the adopted PSR as needed to mitigate <br /> the impacts of the combined Gateway Business Park, <br /> Safeway, and Bay Cities truck stop projects, and which <br /> are recommended by Caltrans staff, shall be funded by <br /> • applicants according to their fair share of the cost, <br /> based upon each project ' s portion of the traffic <br /> generated. <br /> ah. For any Caltrans facilities which have not yet been <br /> completed, prior to building occupancy the developer <br /> shall have completed the design and improvement plans, <br /> have obtained initial approval of the configuration from <br /> Caltrans, and have entered into a secured improvement <br /> agreement with the County, in an amount and form <br /> acceptable to the County Department of Public Works and <br /> County Counsel. <br /> The developer shall post a security bond or other <br /> acceptable security with the County equal to the <br /> estimated cost, plus a 10 percent contingency, of the <br /> improvements identified in the draft or adopted Project <br /> Study Report, or otherwise required by Caltz, ns. <br /> Security shall include the full estimated cost of the <br /> improvements required by Caltrans, including any <br /> estimated cost of right-of-way acquisition which has not <br /> yet been obtained. <br /> Traffic Impact Mitigation Fees: <br /> ai. Bay Cities shall be required to pay San Joaquin County <br /> Traffic Impact Mitigation Fees. However, if it is <br /> determined by the County that the transportation <br /> improvements proposed by Bay Cities and the other <br /> developers should be included in the Traffic Impact <br /> Mitigation Fees program, according to the procedure <br /> outlined in the resolution, then Bay Cities shall receive <br /> credit or reimbursement for eligible facilities <br /> construction. <br /> Credit for transportation construction by Bay Cities and <br />
