Conditions of Approval <br /> UP 88-19 <br /> Page -20- <br /> the other developers will be granted by the County only <br /> if the specific transportation improvements to be <br /> credited are formally added to the improvements listed <br /> in the Traffic Impact Mitigation Fees technical document, <br /> accompanied by a re-examination of the Countywide <br /> transportation impacts and any necessary adjustment of <br /> the impact fees by the Board of Supervisors, or according <br /> to other provisions of the fee ordinance and resolution. <br /> Any credits for transportation improvements will be <br /> awarded according to the process outlined in Section <br /> 4.7 (c) of the accompanying Development Agreement(s) . . <br /> Creation of a County Service Area (CSA) : <br /> aj . The Gateway Business Park, Bay Cities truck stop, and any <br /> other industrial development approved on the remaining <br /> lands within the 285-acre area will be provided <br /> wastewater, water, drainage, and street lighting) <br /> services via the establishment of a County Service Area <br /> (CSA) . <br /> Bay Cities and the other property owners served by the <br /> CSA shall pay the full costs of establishing and <br /> maintaining the CSA and its improvements, including the <br /> cost of any financial liability. The legal <br /> responsibility for funding wastewater, water, drainage, <br /> and street lighting services by the County Service Area <br /> shall reside with those property owners who are included <br /> within the CSA district. The County Board of Supervisors <br /> shall assume no legal or financial lability for <br /> providing services to the property owners or tenants <br /> included within the CSA, in the event of system failures <br /> or other unforeseen events, except to the extent covered <br /> by the Cointy's self-insurance program. <br /> ak. The CSA .is to be formed and operative prior to occupancy <br /> of any buildings. All infrastructure improvements are to <br /> be completed in accordance with the requirements of these <br /> Conditions of Approval and the Services Plan included in <br /> the Development Agreement. <br /> al. Bay Cities and other developers shall deposit adequate <br /> funds with the County prior to the occupancy of any <br /> buildings to pay all costs of operating the <br /> infrastructure systems (wastewater and water treatment <br /> plants, etc. ) during the start up period before the newly <br /> created County Service Area is added to the tax rolls and <br /> is able to begin collecting tax assessments. <br />
