Analysis <br /> Background <br /> The existing bar and restaurant operated as a saloon in the 1890's and is located in the Rural Community <br /> of Banta: The project applicant is proposing to provide karaoke and live indoor entertainment Wednesday <br /> through Saturday from 8:00 p.m. to 1:00 a.m. and on Sunday from 12.00 pm to 7:00 pm. No outdoor <br /> entertainment is being proposed with this application. <br /> Current ordinance regulations regarding entertainment permits normally are reviewed by the Director <br /> using the Staff Review with Notice Procedure and approved at staff level; however, due to the <br /> neighborhood opposition, the application was scheduled for a Public Hearing. <br /> Neighborhood Opposition <br /> The Community Development Department has received several phone calls from surrounding neighbors in <br /> opposition to the application. The concerns raised are excessive noise emanating from the outdoor patio <br /> area during live entertainment events. <br /> -f <br /> Noise: Neighbors expressed concerns regarding the impact of noise to surrounding properties. The <br /> noise performance standard for stationary noise sources requires a daytime (7 a.m. to 10 p.m.) hourly <br /> equivalent sound level to remain below 50 dB with a maximum sound level of 70 dB and.a nighttime (10 <br /> p.m. to 7 a.m.) hourlj.'equivalent sound level to remain below 45 dB with a maximum sound level of 65 dB <br /> (Development Title T- ble 9-1025.9 Part II). There is no evidence to indicate the project will exceed these <br /> standards.
