Approve Entertainment Permit Application No. PA-0800290 with the Findings and Conditions of <br /> Approval contained-in the staff report. <br /> Findings <br /> r <br /> Prior to approving an'application for an Entertainment Permit; the Review Authority shalhfind that all of <br /> the following are true.. , <br /> k <br /> 1. That the proposed Entertainment is accessory to a permitted or conditionally permitted and <br /> established use. <br /> • This finding can be made because the proposed Entertainment Permit is accessory <br /> to an;existing restaurant and bar, and the restaurant and bar has an approved <br /> Business Incense. <br /> 2. That issuance.of the permit and conduct of the entertainment at the proposed location, as <br /> conditioned, is consistent with federal, state.and-local laws, rules, regulations and any existing <br /> Entertainmerit Permit(s). <br /> t <br /> • This finding can be made because the proposed Entertainment Permit is subject to <br /> local ordinance requirements regulating entertainment establishments and to all <br /> applid6ble federal, state and local penal laws including laws for fighting, loud noise <br /> and disorderly conduct. <br /> 3. It does not appear, based upon the information before the Director, that the applicant has provided <br /> false or misleading material information in the application. <br /> • This finding can be made because the entertainment application submitted on March <br /> 4 10, 20:1.0,to the Community Development Department contained the description of <br /> the type of entertainment being proposed and was deemed complete for processing <br /> on Match 16, 2010, by the Community Development Department. <br /> 4. The proposed use is consistent with the standards, and maps of the General Plan; any applicable <br /> Master Plan, Specific Plan, and Special Purpose Plan; and any other applicable plan adopted by <br /> the County. <br /> • This finding can be made because an Entertainment Establishment may be <br /> conditionally permitted with an approved Entertainment Permit application in the C- <br /> RS zone which is an implementation zone for the C-RS General Plan designation. <br /> Additionally, there are no applicable Master Plans or Specific Plans,adopted by the <br /> County in the project vicinity. <br /> u <br /> San Joaquin County;, PA-0800290113anta Inn Properties <br /> Community Developriient Page 4 <br /> A, <br />
