'i <br /> 5. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other <br /> necessary facilities have been provided, and the proposed improvements are properly related to <br /> existing and proposed roadways. <br /> This t<inding can be made because the project will not require new public utility <br /> systems or district boundary changes. All services at the site will be private; any <br /> additional domestic services will be required under permit with the San Joaquin <br /> County Environmental Health Department. Storm water drainage will be retained on <br /> site and the project has frontage along Seventh Street. <br /> 6. The site is ptrysically suitable for the type of development and intensity of development. This <br /> means that tKe site is of sufficient size to accommodate the use and any associated buildings, <br /> parking, utilities, ingress and egress, and other development code requirements.: <br /> This finding can be made because the properties involved are 0.33 acres in size and <br /> the existing restaurant and bar is of adequate size and shape to allow for indoor <br /> entertainment. No outdoor entertainment is being proposed. Additionally, the Site <br /> Plan shows that there is sufficient area for parking and circulation, incompliance with <br /> the Standards of the Development Title. <br /> 7. The proposed entertainment use will not increase the possibility of unsanitary conditions, disease <br /> transmission;dor contamination of soils or water, impair the operation of drainage and wastewater <br /> systems, or otherwise adversely impact public health or the environment. <br /> This finding can be made because an Initial Study for the proposed use found no <br /> potentially significant environmental impacts. In addition, the bar will operate under <br /> permOs from the Environmental Health Department and Department of Alcoholic <br /> Beverage Control. <br /> 4 , <br /> 8. The use is physically compatible with adjoining land use means the proposed land use is capable <br /> of existing alo'�gside of, and will not interfere with, or alter the current land use of;adjoining <br /> properties. <br /> This f'iriding can be made because the proposed use will not interfere with or alter <br /> the current uses on adjacent properties. The existing bar and restaurant operated <br /> as a saloon in the 1890's and has continually operated as a food establishment with <br /> a bar._''No outdoor entertainment is being proposed and the outdoor patio area <br /> cannot be used for overflow event viewing or listening. Additionally,the properties <br /> surrounding the project site are zoned C-RS (Rural Service Commercial)and are being <br /> used for commercial and retail purposes.
