Item No. 4 <br /> PC: 9-17-92 <br /> MS-92.156 <br /> Page 3 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> The 60-acre parcel is owned by Al Caton, Jr., Art Rosetti, Elizabeth Hansen, and Joe Dutra They are <br /> applying for an owner-operator homesite parcel for one of the owners, Joe Dutra. The owners applied <br /> for a Variance (VR-92-4) to permit the division of the 60-acre parcel into two 30-acre parcels. The <br /> applicants withdrew the Variance prior to the public hearing. <br /> The 60 acres is under Williamson Act Contract,which requires a minimum of 10 acres for owner-operator <br /> homesite parcels. <br /> Staff has received five letters of opposition to this Minor Subdivision, so this project is being referred to <br /> the Planning Commission. The opposition is concerned with the impact of the homesite on surrounding <br /> agricultural operations and on the wldfrfe habitat along the Calaveras River. <br /> POLICY CONSIDERATIONS: <br /> Ordinance: <br /> There are five requirements to Section 9-4010.2(a) that must be met, according to the 1995 <br /> General Plan and Planning Title. The applicant has applied under these 1995 provisions: <br /> 1. The homesite parcel must contain a minimum of 1 v, acres. <br /> • The proposal is for a 10-acre homesite. <br /> 2. The original parcel must be at least 20 acres. <br /> The original oarcel is 60 acres. <br /> 3. The purpose of the subdivision is to finance a residence for only one of the owners. <br /> • The applicants have stated that they are going to finance a residence for Joe <br /> Dutra, and he is one of the owners. <br /> 4. If there are several owner-operators, only one homesite may be created. <br /> • Only one homesite is proposed. <br /> 5. If tho narcal is under a Williamson Act Contract, the parcel shall contain a minimum of 10 <br /> acres. <br /> The Tentative Map shows a 10-acre parcel. <br /> The applicant meets all of the requirements of the ordinance. <br />
