Item No. 4 <br /> PC: 9-17-92 <br /> MS-92-156 <br /> Page a <br /> There are three requirements for homesite parcels, according to the 2010 General Plan and <br /> Development Code: <br /> I. The number of parcels resulting from the division shall not exceed the maximum number <br /> of parcels permissible under the General Plan density. <br /> • The project would meet this requirement because the subdivision would permit <br /> two dwelling units on 60 acres, and the General Plan density permits one <br /> dwelling unit for each 20 acres. <br /> <. The homesite must contain a minimum of two acres. <br /> The proposal is for a 10-acre homesite and therefore meets this requirement. <br /> 3. If the parcel is under a Williamson Act Contract, the parcel shall contain a minimum of 10 <br /> acres. <br /> The property is under contract, and the tentative maps show a 10-acre parcel. <br /> AREA COMPATIBILITY: <br /> Land Use: <br /> The opposition is concerned with the impact of the homesite on surrounding agricultural <br /> operations and on the wildlife habitat along the Calaveras River. The addition of one residence <br /> on a 10-acre parcel will not be incompatible with the surrounding walnut orchards, nor will it have <br /> a detrimental effect on wildlife along the Calaveras River. Only a portion of the homesite is within <br /> the 100-year flood plain, and ordinance requirements would require that the home be built outside <br /> this flood plain. <br /> ENVIRONMENTAL CONSIDERATIONS: <br /> The Environmental Initial Study prepared for this Minor Subdivision concluded that the project would not <br /> have a significant, adverse effect on the environment. The riparian area along the south property line <br /> which adjoins the Calaveras River is an important habitat that might support rare or endangered species <br /> of plants and animals. A proposed condition prohibits any modification of the riparian area without <br /> approval of the State Department of Fish and Game and U. S. Fish and Wildlife. On this basis, a Negative <br /> Declaration and a California Department of Fish and Game Certificate of Fee Exemption have been <br /> prepared. <br />
