July 29, 1992 L. <br /> San Joaquin County Planning Division Ul, - 3 1992 <br /> 1810 East Hazelton .JmrlilnVllY Lit ,-. . �& <br /> Stockton, California 95205 'L4NPJING CIUfS''JP+ <br /> Re: Application No. MS-92-0156 <br /> Applicant: River Valley Ranch <br /> 3528 Oakdale Road <br /> Modesto, California 95355 <br /> This is a PROTEST against the above referenced application now pending. <br /> Our Living Trust owns 70 acres of bottom land on the Calaveras side of the county <br /> Line, immediately to the NE of the applicant's parcel. In addition, our Trust owns 255 acres <br /> of pasture on the east side of Shelton road adjoining the previously mentioned 70 acres. <br /> The parcel subject to the pending application is located on a narrow flood plain <br /> between two hills and has floodec many times in the past, and during wet years undoubtedly <br /> will flood in the future. <br /> All of the land on that narrow flood plain is used for intensive agriculture. Any kind <br /> of subdivision, or higher density usage, would be non-conforming and improper, given the <br /> total acreage and uses as the lands are now operated. <br /> We see the present application as another subterfuge to create a series of small <br /> parcels thereby creating the equivalent of a small subdivision, which is contrary to and <br /> incompatible with the present agricultural zoning in effect by both counties for that area. <br /> We consider the present application as a ruse to accomplish the intent of the application <br /> of February 19, 1992 which was withdrawn in the face of opposition. <br /> In addition. the extremely fertile agricultural land of the very narrow Calaveras River <br /> flood pl i supports a significant population of wild life ranging from well below the Shelto❑ <br /> Road to the east where the flood plain ends at Jenny Lind. A development of even modest <br /> density would destroy the wild life which has been so carefully preserved. <br />
