An appropriate CEQA document must identify all the potential
impacts with adequate supporting documentation, available for review, to the avoidance,
minimization, or mitigation of such impacts. (Ref.: California Environmental Quality Act of 1970,
Sections 15378 and 15063, as amended)
The approval of site development permits is subject to CEQA; therefore, an appropriate
environmental document must be completed prior to project approval. (Ref.: City of Antioch v. City
Council of the City of Pittsburgh(1" Dist. 1986) 187 Cal.App.3d 1325 [232 Cal. Rptr_507])
There is no environmental document with this project to review; and therefore, it is impossible to
ascertain the environmental impacts of this project to the State Transportation System. This is
especially important when the project is adjacent to the right of way, contains a direct
encroachment, or land dedication to the State of California.
Please send us a copy of the environmental document(Initial Study for Negative Declaration (with
or without mitigation measures))or the DER when it is available (Ref_- California Environmental
Quality Act of 1970, Sections 15063 and 2109.24, as amended).
While this section does mention some areas of concern, this review can not identify all the potential
impacts that may be discovered during the CEQA process..
It is recommended the applicant contact the Native American Heritage Commission 915 Capitol
Mall,Room 364, Sacramento California 95814, (916)653-4082, (916)657-5390 [FAX] for advice
on consulting with Native Americans regarding any cultural concerns within the project area.
This project will increase the ambient air pollution problem existing in the San Joaquin County.
Please be aware that any increase of negative air quality may well impact negatively on future
transportation projects. There may also be cumulative impacts on the air quality by additional
Projects located in the Lockeford area that should be addressed within your CEQA document. Please
note that the standards for fugitive dust control compliance need to reflect the PM2.5 standards.
(Ref: Sec 176, Clean Air Act(42 I JSC 7506)CEQA Guidelines, 4 15064, subd_(i)(1))
This project indicates that an encroachment permit may be required. If an encroachment is
expected, the CEQA project description must include a brief summary of the anticipated work
within the State right of way. The attached information is to assist the applicant in the permit
process. The approved Environmental Document for the project must be included in the permit
application.
i
Cali mns improves mobility ucross calii/ornia,
