• The current size of the parcel in the proposed project is 90.22 acres. This is <br /> substantially larger than the five (5) to ten (10) acre size requirement for parcels <br /> to be considered for the Limited Agriculture land use designation. By approving <br /> this project, the applicant would be able to submit a Major Subdivision application <br /> to subdivide the site into nine (9) lots of approximately ten acres each. This <br /> action would not be consistent with the General Plan. <br /> Agricultural Land Use Policy 7 (General Plan Volume I Page VI-13) <br /> Preservation of Agricultural Lands/Compatible Uses <br /> There shall be no further fragmentation of land designated for agricultural use, except in the <br /> following cases: <br /> a. Parcels for homesites may be created, provided that the General Plan density is not <br /> exceeded. <br /> b. A parcel may be created for the purpose of separating existing dwellings on a lot, <br /> provided the Development Title regulations are met. <br /> c. A parcel may be created for use granted by permit in the AG zone, provided that <br /> conflicts with surrounding agricultural operations are mitigated. <br /> • The proposed lots that would be created from this application would constitute a <br /> fragmentation of land designated for agricultural use and the exceptions listed do <br /> not apply. The intent of the A/L General Plan land use designation is to recognize <br /> existing concentrations of small parcels in the agriculture areas. Therefore, this <br /> application would not be consistent with the General Plan. <br /> Williamson Act <br /> The parcel is under Williamson Act Contract. About one-third of the property is shown to be prime <br /> agricultural farmland on the Farmland 2002 Map. About two-thirds of the property is shown to be <br /> non-prime agricultural farmland on the Farmland 2002 Map. If the parcel is subdivided into nine <br /> parcels of ten (10) acres each, the parcels would not meet the minimum parcel lot size <br /> requirement of twenty (20) acres for prime farmland and forty (40) acres for non-prime farmland <br /> as stated in the Development Title Section 9-1810 (b) (1) & (2). <br /> Development Title Section 9-1815.3 (b) states that if property under contract is being divided, the <br /> owner of the property shall serve a Notice of Nonrenewal on the County for any resulting parcels <br /> less than ten (10) acres in size in the case of prime agricultural land, or less than forty (40) acres <br /> in size in the case of land which is not prime, prior to obtaining map approval. <br /> PRE-APPLICATION DISCLAIMER <br /> NOTE: The pre-application conference is designed to inform prospective applicants of General <br /> Plan consistency, zoning consistency, public improvement requirements, preliminary design <br /> constraints and opportunities, and major environmental and safety issues.
