V*.. .i <br /> March 28, 2007 <br /> MEMORANDUM <br /> TO: PLANNING COMMISSION <br /> FROM: KERRY SULLIVAN <br /> DIRECTOR / <br /> SUBJECT: ITEM #1- PA-0500224: Use Permit application for a nature preserve, <br /> campground, and conference center to be constructed in three phases. <br /> (Use Types: Recreation—Campgrounds and Recreation—Nature Preserve) <br /> The State Lands Commission sent the attached letter dated March 16, 2007 stating that <br /> the Initial Study/Mitigated Negative Declaration is inadequate to fully evaluate the <br /> project under CEQA. The CDD has reviewed the letter and determined that the Initial <br /> Study is adequate for the proposed Mitigated Negative Declaration. A detailed review of <br /> the letter is provided below with excerpts from the letter in quotes and responses in bold. <br /> "The project description does not provide enough details to assess all potential <br /> impacts from the various phases. The project does not describe how the new docks <br /> and an ADA accessible ramp will be designed and the extent of impacts to the river <br /> bank. The design also needs to consider how any improvements to the river bank <br /> would sustain periodic flooding and river bank erosion." <br /> • Complete construction drawings will be submitted with permit <br /> applications to the U.S. Army Corps of Engineers, Regional Water <br /> Quality Control Board, Reclamation Board, and California Department <br /> of Fish and Game. A field trip with the U.S. Fish and Wildlife Service and <br /> California Department of Fish and Game identified the preferred <br /> location for the ADA accessible ramp to minimize impact to the waters <br /> and the bank. The ramp will require the removal of less than 0.01 acre of <br /> Himalayan blackberry bushes and the relocation of one bunch of reeds to <br /> the south. However, the location of the ramp and landing will avoid all <br /> existing trees. The ramp and landing will be secured with driven piles <br /> and constructed over the existing vegetation. No additional erosion <br /> protection will be needed as construction of the landing and ramps will <br /> not result in the creation of bare ground. The ramp will have at least one <br /> switch back to minimize the slope for those with disabilities. <br /> "The project proposes several restrooms but does not provide type of restrooms being <br /> proposed, source of water, and how the sewer would be treated." <br />
