CONDITIONS OF APPROVAL <br /> SA-99-65 <br /> Garner <br /> Site Approval Application No. SA-99-65 was approved by the San Joaquin County Planning <br /> Commission on November 4, 1999. The effective date of approval is November 14, 1999. This <br /> approval will expire on May 15, 2001, which is 18 months from the effective date of approval, unless <br /> (1)all Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have been secured <br /> and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jeff Fisher,468-9653) <br /> a. IMPROVEMENT PLAN: Submit an Improvement Plan. The Plan must be prepared by a registered <br /> civil engineer or licensed architect. This Plan must show drainage, driveway access details <br /> (including gates), on-site parking, landscaping, signs, existing and proposed utility services, and <br /> grading (refer to "SITE PLAN CHECK LIST' for details). A fee is required for the Plan review. <br /> (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is for a kennel for three breeding dogs and six additional dogs, and <br /> a maximum of 30 puppies per year shall be allowed, as shown on the Site Plan submitted August 3, <br /> 1999(Use Type: Kennels—Small breeding). <br /> c. BUSINESS LICENSE: The applicant shall secure an approved Business License prior to the <br /> initiation of the use. The Business License may be applied for concurrently with the building permit <br /> application. (Section 7-1000 of the County Ordinance Code) <br /> d. PARKING: Paved parking will not be required as long as there is no on-site sale of puppies. <br /> e. ANIMAL REGULATIONS: The following animal regulations apply and shall be provided: <br /> (1) All animal enclosures, including but not limited to pens, cages, and feed areas, shall be <br /> maintained free from litter, garbage, and excessive accumulation of manure so as to discourage <br /> the proliferation of flies, other disease vectors, and offensive odors. The premises shall be <br /> maintained in a neat and sanitary manner. (Development Title Section 9-1045.7[b]) <br /> (2) Except for movement on and off the property, animals shall not be kept or maintained in coops, <br /> pens, corrals, or within barns or similar structures closer than 40 feet from any rear or side <br /> property line.
