i In the event the developer chooses to relocate Flag City Boulevard (formerly DeBroggi <br /> Road) right-of-way easterly 50 feet, ^ ` <br /> farpA 2.n •I • interseation and abandonment of the existing right-of-way shall be <br /> accomplished by separate instrument(s). In any event the developer shall dedicate the <br /> 60' right-of-way for Flag City Boulevard from State Highway 12 south to DeBroggi Road <br /> and including the easter extension of DeBrO i Road, as a 60' right-of-way commercial <br /> road. The developer shall construct the realigned Flag City Boulevard to County <br /> standards for a 60-foot-wide commercial roadway from the edge of pavement of State <br /> Highway Route 12 to the beginning of the curve to DeBroggi Road. <br /> The developer shall construct a transition section to County standards for a 60-foot-wide <br /> commercial roadway from the realigned section of Flag City Boulevard to the existing Flag <br /> City Boulevard realignment. Construction of the remainder of Flag City Boulevard and <br /> DeBroggi Road may be deferred until additional development occurs on the remainder <br /> parcel. The developer shall obtain all necessary permits from Caltrans to construct the <br /> State Highway Route 12 intersection with Flag City Boulevard. (Development Title Section <br /> 9-1100.3) <br /> g. All easements of record shall be shown on the Parcel Map. (Development Title Section <br /> 9-910.20) <br /> h. A community detention pond/terminal drainage system,which will ultimately be integrated <br /> with the drainage system currently under construction in conjunction with the Flag City <br /> development, shall be provided to meet the requirements of the County and to provide <br /> adequate drainage for Parcel 1 and remainder. Construction of the detention pond may <br /> be deferred if it can be determined through an engineering analysis that the drainage <br /> system currently under construction for Flag City does have excess capacity to serve this <br /> project in addition to all the property currently in County Service Area No. 31 or until <br /> further development of any portion of the designated remainder of parcel, whichever <br /> occurs first. (Development Title Section 9-1135.2) <br /> i. The project shall provide a public water system that is connected to the water system of <br /> County Service Area No.31 and conforms to the requirements of the San Joaquin County <br /> Public Health Services (Environmental Health Division) and the Department of Public <br /> Works. The public water system shall include a well, which may be deferred if it can be <br /> determined through an engineering analysis that the water system, currently under <br /> construction, for County Service Area No. 31 does have excess capacity to serve Parcel <br /> 1 in addition to all the property currently in County Service Area No. 31 or until further <br /> development of any portion of the remainder of the parcel, whichever comes first. The <br /> developer shall enter into a secured deferred improvement agreement with the County <br /> to ensure the construction of a well to County standards, if needed. The public water <br /> system shall provide adequate domestic and fire water supply in conformance to the <br /> requirements of the County Fire Warden and the local fire district. A test well showing <br /> that the production weil will meet ail applicable standards is required prior to the approval <br /> of the improvement plans or any work within the site. (Development Title Section 9- <br /> 1120.2) <br /> j. The project shall be served by a public sanitary sewer collection system that is connected <br /> to the sanitary sewer system of County Service Area No. 31 and shall be constructed in <br /> conformance with the requirements of the San Joaquin County Public Health Services <br /> (Environmental Health Division) and the Department of Public Works.
