MS-94-42 OF JOE HALLOUM <br /> (FOURTH SUPERVISORIAL DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Revision of Approved Actions Application for Minor Subdivision No. MS-94-42 <br /> with the Findings and Revised Conditions of Approval contained in the Board Letter as <br /> Attachment A. <br /> BACKGROUND <br /> On February 16, 1995,the Community Development Department approved Minor Subdivision No. MS-94- <br /> 42. That application was for a vesting tentative map to subdivide a 41.9 acre parcel to create Parcel 1 <br /> of 0.97 acres and a designated remainder of 40.9 acres. Flag City Partners appealed the approval to the <br /> Planning Commission based on four issues, one of which was services for sewer and drainage. On March <br /> 16, 1995, the Planning Commission voted to uphold the appeal and deny the Minor Subdivision <br /> Application based on the inability to make Finding No. 7 which deals with access. Joe Halioum appealed <br /> the Planning Commission's denial to the Board of Supervisors. On April 11, 1995, the Board of <br /> Supervisors upheld the appeal and approved the Minor Subdivision with Conditions of Approval. The <br /> Board action and Planning Commission Minutes are included as Attachments B and C, respectively. <br /> PROJECT DESCRIPTION <br /> The request is to revise Public Works Conditions of Approval 2.h and 21 The requested revision to <br /> condition 2.h. is to allow use of unused capacity in the CSA 31 drainage system on an interim basis. The <br /> requested revision to condition 2J is to allow use of unused capacity in the CSA 31 Water system on an <br /> interim basis, with surety, for construction of an approximately 10,000 gallon storage tank, to be posted. <br /> ANALYSIS <br />
