A master plan shall be prepared prior to the development of property <br /> beyond Parcel 1 and a community retention pond/terminal drainage system, which shall be <br /> integrated with the drainage system currently under construction for the Flap City Project shall <br /> be constructed. The design of the terminal drainage system shall recognize the design of the <br /> Outfall line constructed by Flag Cit)&which_was sized only to serve Flag City. <br /> i. The project shall provide a public water system that is connected to the water system of County <br /> Service Area No. 31 and conforms to the requirements of the San Joaquin County Public Health <br /> Services (Environmental Health Division) and the Department of Public Works. The public water <br /> system shall include a well, which may be deferred, if the developer installs a reservoir with a <br /> booster pump or_ pressure tank, which has sufficient 9 9 ^ter' be detorminar- thrr,ugh aR <br /> capacity to serve Parcel 1 in addition to all the property currently in <br /> County Service Area No. 31 or until further development of any portion of the remainder of the <br /> parcel, whichever comes first. The developer shall enter into a secured deferred improvement <br /> agreement with the County to ensure the construction of a well to County standards, if needed. <br /> The public water system shall provide adequate domestic and fire water supply in conformance <br /> to the requirements of the County Fire Warden and the local fire district. A test well showing that <br /> the production well will meet all applicable standards is required prior to the approval of the <br /> improvement plans or any work within the site. (Development Title Section 9-1120.2) <br /> Public Works sent a copy of the proposed revision to the conditions of approval to Joe Halloum and they <br /> indicated that Mr. Halloum is in concurrence with the proposed changes. A letter of opposition, however, <br /> has been received from Jose Alva, the attorney representing Flag-City. This letter is included as <br /> Attachment D. In summary, Mr. Alva is objecting to Mr. Halloum's project utilizing storm drainage and <br /> water capacities that, although not being utilized by Flag City at this time, were constructed by and <br /> designed to serve only the Flag City development. Jose Alva's opposition is that the security bond, <br /> recommended by Public Works, is not adequate protection to insure that sewer and water services will <br /> be available as the balance of the Flag City project develops. <br /> SOS LETTER PAGE 2 <br />
