Item No. 6 <br /> PC: 9-17-92 <br /> MS-92-147 <br /> Page 3 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> The 20-acre parcel is owned by James Baum. He is applying for the family-member homesite parcel for <br /> his son, Robert Baum. <br /> According to the family accountant, Robert Baum earns a substantial portion of his income from farming <br /> the property on Victor Road. <br /> The 20 acres is under Williamson Act Contract, which requires a minimum of 10 acres for family-member <br /> homesite parcels and a Joint Management Agreement to link the original parcel and the famiy-member <br /> homesite parcel. <br /> Staff received a call from an anonymous neighbor who indicated that there was a sign on the property <br /> offering the project site for sale. Staff made a site visit and confirmed the caller's statement. A sign in <br /> front of the property offered for sale this parcel as well as two parcels behind this parcel. The telephone <br /> number given on the sign was the same as given by James Baum on this application. <br /> POLICY CONSIDERATIONS: <br /> Ordinance: <br /> There are six requirements to Section 9-4010.2(b) that must be met, according to the 1995 <br /> General Plan and Planning Title. The applicant has applied under these 1995 provisions: <br /> 1. The homesde parcel must contain a minimum of 11/2 acres. <br /> The proposal is for a 10-acre homesite. <br /> 2 The original parcel must be at least 20 acres. <br /> The original parcel is 20 gross acres. <br /> 3. The purpose of the subdivision is to finance a residence for the family member. <br /> • The applicant has stated that they are going to finance a residence for Robert <br /> Baum; however, the property is being advertised for sale. Therefore, the <br /> proposed use of this property is in question. <br /> 4. The family memher must earn a substantial portion of his or her livelihood from actively <br /> participating in the tarminy operation. <br /> The letter from their accountant indicates that they earn a substantial portion of <br /> their livelihood from farming. <br />
