CONDITIONS OF APPROVAL <br /> MS-93-122 <br /> Victor Goehring <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT <br /> a. All parcels shall have a minimum width of 330 feet. (Development Title Section 9-610.2) <br /> b. Parcel 1 shall be 10 acres in size. (Development Title Section 9-610.3[a][31) <br /> C. A 25-foot-wide private easement for access to Parcel 1, along the west property line of <br /> the remainder, shall be shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> d. The following note shall be placed on the Parcel Map: <br /> • At the time of development of Parcel 2,the entire length of the private right-of-way <br /> for Parcel 2 shall be constructed and maintained to the standards required by <br /> Section 10.207 of the Uniform Fire Code and applicable San Joaquin County <br /> Improvement Standards. (Development Title Section 9-1150.15[c]) <br /> e. Parallel to the Mokelumne River, a natural open space for riparian habitat and waterway <br /> protection shall be maintained to provide nesting and foraging habitat and the protection <br /> of waterway quality. The minimum width of said open space shall be 100 feet, measured <br /> from the mean high water level of the natural bank, or 50 feet back from the existing <br /> riparian habitat, whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. <br /> The mean high water level and the edge of the riparian habitat shall be shown on the <br /> Parcel Map. The open space buffer required above shall be shown on the Parcel Map <br /> with the following note: <br /> • Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water dependent uses shall be permitted <br /> in this space. <br /> f. If, in the course of development, concentrations of prehistoric or historic-period materials <br /> are encountered, all work in the vicinity of the find shall halt until an archaeologist can <br /> evaluate the materials and make recommendations for further action.
