The design of the subdivision or the type of improvements will not conflict with easements, <br /> acquired by the public at large, for access through or use of property within the proposed <br /> subdivision. <br /> • This finding can be made because there are no easements acquired by the public at <br /> large within this subdivision. <br /> 8. Any land or improvements to be dedicated to the County are consistent with the General Plan. <br /> • This finding can be made because any such improvements or land must meet County <br /> standards and requirements for.dedication and/or construction. <br /> 9. The design of the subdivision provides,to the extent feasible,for future passive or natural heating <br /> or cooling opportunities in the subdivision, as required by Government Code Section 66473.1. <br /> • This finding can be made because the two lots are large enough so that structures <br /> can be situated to take advantage of solar orientation. <br /> Site Approval Findin s <br /> 1. The proposed use is consistent with the goals, policies,standards,and maps of the General Plan, <br /> any applicable Master Plan,Speck Plan,or Special Purpose Plan,and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the use proposed is consistent with the <br /> Community Commercial designation of the General Plan, which In turn Is permitted <br /> in the Community Commercial zone. No other plans apply. <br /> Z Adequate utilities,roadway improvements,sanitation,water supply,drainage,and other necessary <br /> facilities have been provided,and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because all utilities, Improvements, and other facilities will <br /> be provided. The Linden County Water District will provide public water and sewer. <br /> Storm drainage will be by a private retention basin approved by the Department of <br /> Public Works as an Interim solution until the Storm Drainage Master Plan for Unden <br /> Is constructed. At that time, the proposed parcels will be required to pay their fair - <br /> share and connect. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the property Is adequate In size to accommodate <br /> provisions of the Development Title. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the proposed use Is compatible with the <br /> surrounding area and will not have an adverse effect on nearby properties. <br /> San Joaquin County MS-96.37, SA-96-84/Oriando <br /> Community Development page 9 <br />
