E <br /> KENT RAVERTY <br /> Findings for a Partial Williamson Act Cancellation <br /> (Contract Nos. 69-C1-3, 00-01 & 05-987) <br /> (California Government Code §51282) <br /> BACKGROUND STATEMENT <br /> Kent Raverty and his family own and reside on approximately twenty three (23) acres of <br /> land in San Joaquin County off of Peltier Road west of Highway 99. Approximately sixteen(16) <br /> acres are in walnuts and one (1) acre is in grapes. The rest of the property is comprised of the <br /> family residence and four(4) other outbuildings. <br /> In December of 2008, Mr. Raverty applied for and received a Use Permit from San <br /> Joaquin County for an Off-Site Wine ry (PA- <br /> 0800266). Without adding to or deleting from the <br /> existing family residence and the existing four (4) outbuildings, Mr. Raverty converted two (2) of <br /> the existing outbuildings to an Off-Site Wine Cellar and Wine-Tasting Room/Banquet Room all <br /> in compliance with the current San Joaquin County Development Title for Wineries and Related <br /> Facilities. <br /> Mr. Raverty and his family have recently applied for a Site Approval for a Bed and <br /> Breakfast facility in the existing family residence. The 'Bed and Breakfast would be an <br /> appropriate ancillary use with the existing Off-Site Winery. The San Joaquin County <br /> Development Title allows the Bed and Breakfast use in the General Agricultural zone subject to <br /> obtaining a Site Approval. However, the Bed and Breakfast use is not a compatible use with the <br /> existing Williamson Act Contract. <br /> The purpose of the one (1 +/-) acre partial cancellation of the Williamson Act Contract is <br /> to delete the existing family residence, the existing driveway and the existing swimming pool <br /> area from the contract. This will only remove one (1+/-) acre out of the existing twenty-three <br /> 23 acres from the contract area. More importantly, the contract deletion is for the existing <br /> ( ) g <br /> family residence, the existing driveway and the existing swimming pool. Therefore, no <br /> disturbance, encroachment or interference will occur to the existing and ongoing seventeen (17) <br /> acres of agriculture (walnuts and grapes). In essence, the "before" and "after" will be identical. <br /> Seventeen(17) acres are currently in agriculture and seventeen(17)will remain in agriculture. <br /> 1 <br />
