F <br /> FINDINGS <br /> 1. The cancellation is consistent with purposes of the Williamson Act. <br /> a. The cancellation is for land on which a Notice of Nonrenewal has been <br /> served pursuant to Section 51245 of the Government Code. <br /> Finding: The Property has a Notice of Nonrenewal filed on <br /> ,2009. <br /> b. The cancellation is not likely to result in the removal of adjacent lands <br /> from agricultural use. <br /> Finding: The one (1+/-) acre cancellation for the existing residence, <br /> the existing driveway and the existing swimming pool <br /> will support the Bed and Breakfast project description <br /> and no further land area is or will be required. <br /> Therefore, no adjacent agricultural land will be disturbed <br /> or be removed from agriculture. <br /> C. The cancellation is for an alternative use which is consistent with the <br /> applicable provisions of the County General Plan. <br /> Finding: The existing San Joaquin County General Plan Land Use <br /> Matrix allows a Bed and Breakfast use type in the General <br /> Agricultural zone with an approved Site Approval. <br /> The one (I+/-) acre will not occur until and unless a Site <br /> Approval is obtained. <br /> d. The cancellation will not result in discontiguous patterns of urban <br /> development. <br /> Finding: The one (I+/-) acre cancellation is for the already existing <br /> f residence, driveway and swimmingpool and is contiguous <br /> to the existing entrance to the property and, in addition, the <br /> Bed and Breakfast facility will continue to utilize the <br /> existing ingress and egress circulation pattern without any <br /> disruption or interference with the existing seventeen <br /> (17+/-) acres of agriculture. <br /> e. There is no proximate noncontracted land which is both available and <br /> suitable for the use to which is both available and suitable for the use to <br /> which it is proposed the contracted land be put, or that development of the <br /> 2 <br />
