-2- <br /> A Williamson Act Contract Cancellation is required because a bed and breakfast inn is <br /> not a compatible use. <br /> REASONS FOR RECOMMENDATION: <br /> Mike Hakeem, attorney for the applicant, spoke in favor of the Williamson Act Contract <br /> Cancellation and the bed and breakfast inn. He stated that no agricultural activities were <br /> occurring on the 1.2 acres. The 1.2 acres contained a residence, pool, and driveway. The <br /> Department of Conservation could also make the Principles of Compatibility. Seventeen <br /> acres of the 22.6-acre parcel are planted with an orchard and a vineyard. <br /> Katie Patterson, representing the Farm Bureau, spoke in opposition to the project. She <br /> stated that this project is a part of a larger project, the winery with its marketing events, <br /> which should also be included in the Williamson Act Contract Cancellation. She also <br /> stated that the steps taken to process the application were not procedurally correct. <br /> Mark Myles, County Counsel, clarified the application process and stated that the process <br /> was procedurally correct. <br /> The Planning Commission considered these matters at its regular meeting on February 4, <br /> 2010. After consideration of all oral and written testimony, the Planning Commission <br /> voted 4-0 to forward the Williamson Act Contract Cancellation application and the Site <br /> Approval application to the Board of Supervisors with the above recommendations. <br /> By State Law, the Board of Supervisors may grant tentative approval for cancellation on <br /> a Williamson Act Contract only if it makes one of the following findings: <br /> (a) That the cancellation is consistent with the purposes of the Williamson Act ; or <br /> (b) That the cancellation is in the public interest. <br /> Both of these findings include subtindings that the Board must also make. The Planning <br /> Commission based its recommendation for approval on the ability to make Finding (a). <br /> Me following is an analysis of the Commission's findings including the subfindings: <br /> Finding (a): That the cancellation is consistent with the purposes of the Williamson <br /> Act <br /> Sub-finding I <br /> The cancellation is for land on which a Notice of Nonrenewal has been served pursuant <br /> to Section 51245 of the Government Code, <br />
