urban retail stores, supermarkets and grocery stores, convenience or mini-markets, full-service eating <br /> establishments, bakeries, flea markets, farmer's markets and mobile eating facilities, are to be discouraged. <br /> A restaurant (Use Type: Eating Establishment-Full Service) is not a permitted use and is excluded from <br /> the use type pursuant to Development Title Section 9-115.515. There is an existing fireplace that was <br /> used as a pizza oven without benefit of the required permits and is not to be used in conjunction with the <br /> agricultural store. <br /> As a Condition of Approval, the floor area for retail sales, including the eating area square footage (i.e. <br /> customer seating)will need to be identified when the applicant submits building permit plans. <br /> Williamson Act <br /> This parcel is subject to Williamson Act Contract No. PA-050305. The contract restricts development to <br /> uses that are compatible with the Williamson Act and Development Title Section 9-1805. "Compatible use" <br /> as defined in the Williamson Act includes uses determined by the County to be compatible with the <br /> agricultural, recreational, or open-space use of land within the preserve and subject to contract. <br /> (Government Code Section 51201[e]) The Produce Sales-Agricultural Store, Large Use Type is a <br /> compatible use with property under contract pursuant to Development Title Section 9-1810.3(b)(1)(u). The <br /> parcel has approximately 15 acres of crops, including tomatoes, squash, pumpkins, watermelons, peppers, <br /> cucumbers, apples and peaches, and the agricultural store will encompass approximately one acre.
