"Intent' of County Code to"Wineries and Related Facilities" <br /> The County's land use policy for wineries and wine-related"marketing events"is <br /> stated clearly in the Code's"Intent"section on Wineries regulation, essentially that: <br /> 1) "A major purpose" of the Code "is to guarantee that" winery "marketing <br /> events are accessory and are subordinate to the primary agricultural use'; and <br /> that <br /> 2) The Code's regulations are designed to help the wine industry thrive"while <br /> simultaneously discouraging or inhibiting on-going uses that would degrade or <br /> that would be incompatible with the ambiance of an agricultural area and the <br /> production of wine." (SJC Code §9-1075.1.) <br /> C. Applicants' Behavior Has Already Blatantly Violated the Code and Their 2005 <br /> Permit <br /> C. 1. The St.Jorge Winery Has Operated as a"Full Service Event <br /> Destination" <br /> As explained in some detail below (and more extensively in the Isolas' Comment <br /> Letter), the St. Jorge Winery business received a permit from the San Joaquin County <br /> Community Development Department in 2005. Since then the St. Jorge Winery has been <br /> conducting its operations well beyond the terms not only of that permit, but beyond the <br /> laws of the San Joaquin County Code as well. <br /> These illegal business operations already conducted include: <br /> • Advertising the Winery as"a fall service event destination"(gge"Attachment A?),which <br /> offers <br /> • "All the necessary attention to detail for weddings, banquets, or small <br /> gathering,"with <br /> • The serving of food at large events,by <br /> • "Using our state of the art [uninspected, unlicensed and unapproved] <br /> commercial kitchen,"including <br /> • The use of amplified music, although prohibited by permit,while <br /> • Holding more than its permitted four events a year,with <br /> • More than its permitted 25 people per event, none of which is allowed in <br /> the Winery's current 2005 San Joaquin County permit. <br /> incompatible with the ambiance of an agricultural area and the production of wine."
