4 <br /> C.2. The St.Jorge Winery's Land Uses and Business Operations Are <br /> Contrary to San Joaquin County Code Land Use Policy <br /> Contrary to the County's land use policy for wineries and wine-related "marketing <br /> events," the owners and operators of the St. Jorge Winery have routinely and deliberately <br /> conducted their"marketing events"business operations in a manner which: <br /> 1) Is in no way `accessory and subordinate to the primary agricultural use' as <br /> required by law; <br /> 2) Is in fact incompatible with the ambiance of the mixed <br /> agricultural/neighborhood area in which they are located; and which <br /> 3) Has in fact already degraded the ambiance of that area for its residents and <br /> their pre-existing, legally conforming land uses. <br /> The size and scope of what is proposed has already proven itself to the <br /> neighborhood's residents to be well removed from the "strong nexus [which] must exist <br /> between the marketing event and the production or storage of wine" as the Code so <br /> explicitly states. Likewise, it has already been shown that the focus of the marketing <br /> events is not wine, but "social gatherings, weddings," etc., etc., where many kinds of <br /> alcohol has been served. <br /> D. Applicants'Proposed Behavior Violates the Code <br /> As outlined above, it is San Joaquin County's stated land use policy for wineries <br /> and wine-related"marketing events"that"a major purpose"of the County Code is to: <br /> a) Guarantee that winery marketing events are"accessory and subordinate to <br /> the primary agricultural use,"and <br /> b) Discourage or inhibit on-going uses that would"degrade or be incompatible <br /> with the ambiance of an agricultural area and the production of wine." (SJC <br /> Code § 9-1075.1.) <br /> D. 1. "Accessory and Subordinate to the Primary Agricultural Use" and <br /> "Incompatible" <br /> In fact, the Vierras have been operating their St. Jorge Winery well beyond the <br /> terms of their 2005 permit, and County land use policy, for years. Their so-called`winery <br /> marketing" events are actually "full service events," and as such are neither "accessory" <br />
