Findings 1,2,4 &5 are Being Appealed <br /> As outlined above, findings 1, 2, 4 & 5 are being appealed. The reasons why are <br /> given above. <br /> B. Conditions Lb., Le., & 1.k. are Being Appealed <br /> The Community Development Department made a series of conditions. Condition 1.b., "Approved Use" <br /> The condition reads: <br /> "APPROVED USE: This approval is for the expansion of a small winery as <br /> shown on the revised site plan dated July 31, 2012. The expansion includes the <br /> construction of a 5,652 square foot wine garden, a 300 square foot commercial <br /> kitchen, a 1,600 square foot storage building, a 336 square foot wine storage <br /> building, a 288 square foot covered patio, and a 420 square foot restroom facility. <br /> The winery will hold a maximum of twenty-four marketing events per year with a <br /> maximum attendance of 150 people as submitted in the marketing plan dated July <br /> 31, 2012. (Use Type: Wineries and Wine Cellar-Winery, Small)" <br /> C. 1. Reasons Why the"Approved Use" Condition Should Be Modified or <br /> Removed: <br /> The 2005 St. Jorge Winery application allowed but two buildings, one 3,000 sq. ft. <br /> and the other 3,840. The proposed 2012 Expansion Application seeks to more than double <br /> this(increase it by—125%). <br /> The square footage component of the 2012 expansion request demonstrates clearly <br /> the extent of the violations conducted under the 2005 permit. <br /> Here are (1) the St. Jorge Winery facilities and square footages sought and <br /> approved in the 2005 permit, compared to (2) those already in use and seeking after-the- <br /> fact legitimization now in 2012: <br />
