Comment Letter <br /> St. Jorge Winery 'Site Approval Application"PA-1200063 <br /> B. The 2005 Permit's Terms <br /> 1. The Development Department's"Conditions of Approval' <br /> A permit was ultimately granted for the"small winery." On July 22,2005 the <br /> Development Department sent a letter to Vern Vierra informing him that on that day the <br /> Department approved his application"subject to the enclosed Conditions of Approval." A three- <br /> page"Conditions of Approval'document was enclosed with that letter. <br /> The County's"Conditions of Approval"address various things,with much boilerplate. <br /> The pertinent parts of those Conditions for the purposes of this Comment Letter are as follows <br /> (pg. 1,reproduced verbatim): <br /> b. APPROVED USE: This approval is for a Small Winery as shown on the Plan dated <br /> May 17,2005 (Use Type:Wineries&Wine Cellars-Winery, Small). Approved uses <br /> are as follows: <br /> (1) 3,000 square foot building to be used for lobby sales and display,lab,wine <br /> processing room and temporary barrel storage. <br /> (2) 3,840 square foot building to be used for wine tasting,barrel storage,and to <br /> include a 512 square foot second unit dwelling. <br /> C. MARKETING EVENTS: Marketing Events shall comply with the following <br /> regulations: <br /> (1) A maximum of four(4)marketing events shall be permitted annually as <br /> described in the marketing plan dated May 18,2005. <br /> (2) Marketing events shall end by 10:00 p.m. <br /> 2. The County's"Conditions of Approval"Allows Marketing Events"As <br /> Described in the Marketing Plan Dated May 18,2005" <br /> As noted above,the Conditions of Approval states"Marketing Events shall comply with <br /> the following regulations: (1) A maximum of four(4)marketing events shall be permitted <br /> annually as described in the marketing plan dated May 18,2005:' <br /> 3. The 2005 Application's Required"Winery or Wine Cellar Supplemental <br /> Information and Marketing Plan"Information <br /> As a part of the county's application process,the Vierras filled out a"Winery or Wine <br /> Cellar Supplemental Information and Marketing Plan"form required by the Community <br /> Development Department. The three-page form's numbering and formatting are internally <br /> inconsistent. <br /> The 2005 'Marketing Plan"form requires the applicant to define the limits of their <br /> proposed business operation. There are two major headings in the Marketing Plan in which these <br /> appear,(1)"B.Marketing Events,"and(2)'T.Traffic." <br /> 4 <br />
