Comment Letter <br /> St Jorge Winery "Site Approval Application"PA-1200063 <br /> 4. The Combined Terms of the"Conditions of Approval" and the"Marketing <br /> Plan" <br /> When one combines the Conditions of Approval's terms with those submitted by the <br /> applicants in their May 18,2005 Marketing Plan,the 2005 permit's"Marketing Event'pertinent <br /> terms are these: <br /> Number of Events and Attendees,Sound: <br /> A maximum of"{aur"for-profit,"wine tasting only,""Crushing festive tour"events a <br /> year,which are on"weekends"from"August through October." No more than"25'people, <br /> "none"amplified sound allowed. <br /> Food: <br /> Food will be by"catering,"prepared by"partial warming"or"barbeque," There are <br /> "none"existing or proposed kitchen equipment and eating areas. <br /> Venue and Staff: <br /> The events will occur in two buildings, will require up to one part-time and two full- <br /> time employees, and will use one truck delivery/pick-up per event. <br /> Hours of Operation: <br /> The events'hours of operation are either(a)"11 a.m.to 5:00 p.m. (weekends)",or(b) <br /> end by 10:00 p.m. <br /> D. 2005 Permit Time Extension Granted in 2007 <br /> 1. The Development Department Grants a Time Extension for Compliance <br /> On or about March 8,2007,the Community Development Department sent Vern Vierra a <br /> letter stating that"On March 8,2007,the San Joaquin County Development Department <br /> approved a one-year Time Extension for PA-0500306 [the Vierra's 2005 permit application <br /> number]." <br /> The letter states further that: <br /> "This action requires you to comply with all of the original Conditions of <br /> Approval by January 31,2008,the new expiration date. If you have not completed the <br /> Conditions of Approval by that date,this approval will expire,and the project cannot <br /> proceed." (Emphasis added.) <br /> The full breadth of"all of the original Conditions of Approval"go beyond the detailed <br /> scope of this Comment Letter and are not discussed herein. <br /> 2. There is No Record of the Required Compliance <br /> There appears to be no indication in the Department's records that"all of the original <br /> Conditions of Approval"were ever complied with, as explicitly required. <br /> If this is so then"this approval will expire, and the project cannot proceed." <br /> 7 <br />
