The Vierras' 2012"Special Event"Application Seeks Further After-The-Fact <br /> Legitimization <br /> The Vierras submitted their"Special Event"forms to the County on May 21,less than <br /> three weeks after the County initiated its enforcement action against them(April 12'). <br /> It is of peculiar interest to note that on May 2°d the Vierras asked the County for its <br /> required permission to hold"special events"on the upcoming dates of May 183i,June P"-31(an <br /> "event"which is three days long--is three days within the County's definition of a"special <br /> event"?),June 2931 and August 24"'. <br /> These"special events"were obviously planned and contracted for beore the Vierras got <br /> caught by the County. Thus the"special events"application is simply another vehicle by which <br /> the scofflaw applicants seek after-the-fact legitimization of their business operations. <br /> 4. Commission Approval Without Sanction Will Reward Illegal Behavior, <br /> Contrary to County Code <br /> Approval of this expansion application would clearly be rewarding illegal behavior, <br /> following it with bad procedure. The result will be dysfunctional government and degraded <br /> communities. That is exactly what the San Joaquin County Code seeks to prevent in regulating <br /> winery land use: <br /> "A major purpose of this Chapter [9-1075,"Wineries and Related Facilities"] is <br /> to guarantee that[...] winery[...] marketing events are accessory and are <br /> subordinate to the primary agricultural use.
