Comment Letter
St Jorge Winery"Site Approval Application"PA-]200063
IV. FRAUD IN THE 2005 APPLICATION AND THE BUSINESS CONDUCT SINCE
A. The Terms of the 2005 Permit Did Not Contemplate"Full Service Event
Destination"
1. Internet Advertising
The terms of the 2005 permit as requested and granted are sparse, and a far cry from
what the Vierras have advertised and actually provided for hire. As noted, they are a"full service
event destination"with so much more than the simple"wine tasting"their 2005 application
represented they intended to offer:
"We are a full service event destination. St.Jorge Winery can provide all the
necessary attention to detail for weddings, banquets, or small gathering. Your event can
be held at St.Jorge in our breathtaking barrel room, magnificent tasting room or outside
in the beautiful courtyard. St.Jorge can cater your gathering using our state of the art
commercial kitchen... . St. Jorge can also offer an exquisite suite for rent, before or after
events. ... St.Jorge Winery is the perfect place to have an anniversaryparty, birthday
celebrations, receptions, luncheons and social affairs, both formal and casual."
2. Fraud in the Operation of the"Small Winery"
What the Vicrras requested and received permit to do in 2005 is a far cry from what they
have actually done since. As seen above, they have engaged in a business campaign calculated to
provide services well beyond that they represented in applying for,let alone what was actually
allowed by, their 2005 permit. These are most definitely not"small winery"services.
This wide departure between(a)what was represented will be done to receive the permit
and(b)what has actually been deliberately and carefully done once the permit was granted is a
fraud upon the County and its land use regulation process.
B. The 2012 Expansion Application Seeks More Than Double the Current Permitted
Area
The 2005 application allowed but two buildings, one 3,000 sq. $. and the other 3,840.
The 2012 Expansion Application seeks to more than double this(increase it by—125%).
The square footage component of the 2012 expansion request demonstrates clearly the
extent of the violations conducted under the 2005 permit.
Here are(1)the St.Jorge Winery facilities and square footages sought and approved in
the 2005 permit, compared to(2)those already in use and seeking after-the-fact legitimization
now in 2012:
14
