The applicant submitted a letter dated May 2, 2012 requesting a reduction in <br /> the number of parking spaces to a total of fifty-two (52) parking spaces because the majority of proposed <br /> buildings are used as warehouse and storage of bulk wines. <br /> The Community Development Department has reviewed the request and is recommending that a <br /> reduction in the number of parking spaces to fifteen (15) parking spaces, instead of the required twenty- <br /> one (21) parking spaces, can be approved for the winery expansion. In addition to the fifteen (15) parking <br /> spaces required for the winery expansion, fifty additional overflow parking spaces shall be required on- <br /> site for the marketing events. The additional marketing event parking spaces must also be shown on the <br /> Improvement Plan. <br /> Site Approval application No. PA-0500306 required seventeen (17) parking spaces for the existing <br /> winery. As a Condition of Approval, at full buildout, the applicant shall provide a total of thirty-two (32) <br /> parking spaces, including two (2) accessible spaces, one (1) which shall be van accessible and fifty (50) <br /> additional marketing event overflow parking spaces, <br /> Neighborhood Opposition <br /> The Community Development Department has received nine letters in opposition, including one letter <br /> from the Farm Bureau, and a form letter in opposition signed by thirteen people. The letters of opposition <br /> expressed concerns regarding the projects impacts on noise, traffic, land use, services and aesthetics. <br /> Noise: The applicant indicated there will be amplified sound both indoors and outdoors at the marketing <br /> events. Neighbors in opposition expressed concern regarding the amplified noise from the marketing <br /> events. The nearest residence is located 115 feet south of the project site. The proposed wine garden <br /> structure will serve as a stage area for concerts and is located approximately 400 feet north of this <br /> nearest residence. Pursuant to Development Title Section 9-1025.9(a)(1), a residential use is a noise <br /> sensitive land use. Amplified sound is permitted at both indoor and outdoor special events and both <br /> \. indoor and outdoor marketing events pursuant to Development Title Section 9-1075.5(i). However, a <br /> noise study was required to identify possible mitigation measures for any amplified noise source impacts <br /> on surrounding residences. A noise study was conducted by J. C. Brennan and Associates dated <br /> August 2, 2012. The noise analysis included conducting a staged concert. One opposition fetter stated <br /> the noise study is useless because there were no controls of any type on sound levels employed in the <br /> study. However, the owners of the winery were requested to set up a sound system on the stage area <br /> and in the direction of typical music. In addition, it was requested that that the music was played at <br /> amplitude (loudness)which they felt was typical of the music which currently plays in the courtyard area. <br /> The music selection was Travis Vega, which includes a band comprised of a bass, guitar, horns, drums <br /> and vocals. <br /> The noise study analyzed existing background noise levels, proposed wine garden noise levels, and <br /> previous music venue noise levels in the courtyard and concluded the wine garden can comply with the <br /> county noise level standards provided the following recommendations are implemented: <br /> 1) Conduct periodic noise measurements during events at the Control Site. Maximum noise levels <br /> due to live events should be monitored at the control site (Site Z in this report), and should be <br /> limited to less than 75 dBA Lmax. <br /> 2) The winery staff is trained on how to use the sound level meter, use the proper settings on the <br /> meter and the meter is calibrated prior to events. The sound level meter shall comply with an <br /> ANSI Type 1 or Type 2 certification. <br /> 3) Events are required to terminate prior to 10:00 p.m. <br /> These mitigation measures will be incorporated into the Conditions of Approval. Additionally, the project <br /> is subject to the Development Title's stationary noise standards (50 dB Hourly Equivalent Sound Level <br /> San Joaquin County PA-1 200063/St. Jorge Winery <br /> Community Development Page 4 <br />
