Marketing events must end by 10:00 p.m pursuant to <br /> Development Title Section 9-1075.8 (m)(2). According to the noise study, the incorporation of these <br /> mitigation measures and code requirements as Conditions of Approval will ensure any noise impacts from <br /> this project will be reduced to less than significant. <br /> Traffic: Neighbors are concerned the proposed expansion will increase traffic that will impact the <br /> surrounding roadways. The applicant stated there will be a maximum attendance of 150 people at the <br /> marketing events and is able to provide the minimum required number of parking spaces on-site. Fifty <br /> (50) parking spaces will be required for the marketing events (one parking space for every three <br /> marketing event attendees).Additionally, the Department of Public Works determined that the project <br /> would not require a traffic study as the applicant expects a maximum attendance of 150 people and <br /> generates less than 50 trips per any one hour, which is the threshold for requiring a traffic study. As a <br /> Condition of Approval,the Department of Public Works reserves the right to require a traffic study if any <br /> marketing events are held for more than 150 people. Additionally, as a Condition of Approval, all vehicular <br /> parking related to the winery shall be on-site at all times and parking in the County right-of-way for all <br /> winery related events shall be prohibited. Therefore, any impacts from traffic are expected to be reduced <br /> to less than significant. <br /> Land Use: Neighbors expressed concerns regarding the project's compatibility with surrounding <br /> agricultural uses and expressed concern the winery is an event center with advertisements for weddings <br /> and concerts which are not compatible within an agricultural area. This project conforms with the current <br /> zoning of AG-40 (General Agriculture-40-acre minimum)and the General Plan designation of A/G <br /> (General Agriculture)and OS/RC (Resource Conservation). The surrounding uses are agricultural with <br /> scattered residences along the perimeter of the property. The proposed Wineries and Wine Cellars- <br /> Winery, Small use type may be conditionally permitted in the AG-40 zone subject to an approved Site <br /> Approval application. <br /> The winery ordinance permits marketing events as an accessory use to a winery(Development Title <br /> Section 9-1075.5(m))with a discretionary permit. Development Title Section 9-1075.1 states "The intent of <br /> the Wineries and Related Facilities Chapter of the Development Title is to establish regulations that will <br /> acknowledge the distinctive pairing of wine grape growing,wine making,and tourism.The challenge is to provide <br /> for agricultural tourism and marketing activities while ensuring that agricultural resources remain vital.A major <br /> purpose is to guarantee that both winery and wine cellar marketing events are accessory and are subordinate to <br /> the primary agricultural use". Marketing events can take many forms, but they all must promote wine and <br /> have wine from the associated vineyard for sale. Marketing events shall end by 10:00 p.m. pursuant to <br /> Development Title Section 9-1075.5(m)(2).The applicant has indicated the marketing events are <br /> specifically geared to sell their wine. <br /> Services: Neighbors are also concerned with the impacts the project will have on existing water, <br /> sewage, and drainage services. The project site is not required to be served by public services. As <br /> Conditions of Approval, an addendum to the soil suitability/nitrate loading study shall be submitted to the <br /> Environmental Health Department(EHD)addressing the increased number of marketing events and <br /> number of attendees. Additionally, construction of an individual sewage disposal system under permit <br /> and inspection by the Environmental Health Department is required at the time of development based on <br /> the soil suitability/nitrate loading study findings. All drainage must be retained on-site. The Department <br /> of Public Works is requiring, as a Condition of Approval,that the developer provide drainage facilities to <br /> meet the requirements of San Joaquin County's Development Standards to prevent runoff release rate of <br /> storm water from discharging onto other properties and to prevent offsite sediment transport.
