Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit No. PA-0500607 with the Findings and Conditions of Approval contained in
the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the continued operation of the telecommunications
monopole and the addition of twenty (20)feet to the height do not conflict with the General
Plan. The use proposed in application PA-0500607 may be conditionally permitted in the R-
L zone with an approved Use Permit application. A telecommunications monopole is
consistent with the R/L General Plan designation, which in turn is permitted in the R-L
zone.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because adequate utilities, access roads, drainage and other
necessary facilities have been provided, and the proposed improvements are properly
related to existing and proposed streets and highways. The addition of twenty (20) feet in
height does not require any additional facilities.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the property involved is of adequate size and shape to
accommodate the proposed use. All yards, building coverage, setbacks, parking areas and
other requirements of this Title are shown on the Site Plan dated September 1, 2005.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because an Initial Study prepared for this project found no
potentially significant environmental impacts.
5. The use is compatible with adjoining land uses.
• This finding can be made because with the Conditions of Approval the proposed use will
not interfere with or alter the current uses on adjacent properties. All residential structures
are located outside the fall zone of the tower. The nearest residence is over three hundred
(300) feet to the east.
San Joaquin County PA-0500607\Portuguese Club
Community Development Page 4
