Item No. 3 <br /> PLANNING COMMISSION MINUTES <br /> APRIL 7, 1988 <br /> 5. USE PERMIT APPLICATION NO. UP-88-18 OF WILLIAM & MARIA BARRY for a <br /> private dog kennel (a maximum of 15 adult dogs ) . The property is <br /> located on the south side of Tokay Colony Road, 1620 feet east of <br /> Hibbard Road, southeast of Lodi. (Supervisorial District 4 ) <br /> Associate Planner Wylla Satterness introduced a staff report into the <br /> record. She noted that the description of the facility has been <br /> revised to read a private dog kennel (a maximum of 15 adult dogs ) , <br /> rather than 15 Irish Wolfhound dogs. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: William Barry was present and said he and his wife bought <br /> the property in 1986 with the intent of keeping their Irish Wolfhound <br /> dogs there. They breed and show them. It is not intended to have a <br /> commercial business. They simply want to keep up to 15 of their dogs <br /> on the property. These dogs have short life spans (7-10 years ) and <br /> they need to maintain a certain number of dogs in that as the older <br /> dogs retire from the show ring, they are replaced. They sometimes <br /> keep two dogs from a litter and sell the rest. They have no intention <br /> of keeping any other breed of dog. The Irish Wolfhounds are gentle <br /> and are easy keepers. The five acres is necessary for an exercise <br /> area. Mr. Barry said he has modified his plan in order to meet the <br /> requirements of the Use Permit. He constructed one length of solid <br /> fence to reduce the dogs ' view of the adjoining property. They plan <br /> to continue fencing the rest of the property. This breed is not a <br /> barking breed, but they do bark when they see something. Mr. Barry <br /> said he accepts the conditions listed in the staff report. He said he <br /> felt strongly about not being a nuisance in the neighborhood. Once he <br /> gets his permit approved, he will set up the kennel to meet the con- <br /> cerns of the neighborhood and the County. He said he presently has 11 <br /> dogs. <br /> Carol Shier, Tokay Colony Road, said her home is three residences <br /> down. She said the Barrys keep their dogs very clean. Further, the <br /> dogs have never awakened her family at night. <br /> OPPONENTS: <br /> Donna Harris, 12836 Tokay Colony Road, said she lives next door to the <br /> Barrys ' property. She said the property is very clean but the dogs <br /> create a tremendous amount of noise. Letters of concern were sub- <br /> mitted to the Commission. There is a problem with the dogs barking <br /> and howling at least three times a day. The noise lasts from three <br /> seconds to a minute. This barking causes the other dogs in the neigh- <br /> borhood to bark and howl. The fence was constructed but it has not <br /> solved the problem. She said that she has counted as many as 25 dogs <br /> ( including puppies ) on the property. Her children take naps and this <br /> noise disrupts their rest.
