CONDITIONS OF APPROVAL <br /> MS-97-20 <br /> NELDON WHITMER <br /> Minor Subdivision Application No. MS-97-20 was approved by the San Joaquin County <br /> Community Development Department on January 8, 1998_. The effective date of approval is <br /> January 18, 1998. This tentative map approval will expire on January 17, 2001, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been <br /> complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be <br /> fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number <br /> have been identified as Ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Tom Gau, 468-2344) <br /> a. TENTATIVE MAP: The Parcel Map shall conform to the Tentative Map dated October 16, <br /> 1997. <br /> b. SECOND UNIT DWELLING: The applicant shall file for a Second Unit Dwelling application <br /> on Parcel 2 to approval of the Parcel Map. <br /> c. MINOR SUBDIVISION RESTRICTION: A statement shall be placed on the Notice of Minor <br /> Subdivision that the existing shop on Parcel 1 shall not be used for commercial or industrial <br /> uses. <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Staff Contact: Richard Hieb, 468-3000) <br /> See attached memo dated November 19, 1997. <br /> 3. PUBLIC HEALTH SERVICES: (Staff Contact: Ted Norgard, 468-3441) <br /> See attached memo dated November 24, 1997, <br /> 4. DEPARTMENT OF PARKS AND RECREATION: (Jeff Smith, 953-8800) <br /> See attached letter dated November 4, 1997. <br /> COUNTY COUNSEL.- <br /> a. <br /> OUNSEL:a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section 66499.37 of the Government Code. <br />
