• This finding can be made because: <br /> The Mountain House Development Agreement (the Amended and Restated <br /> Master Plan Development Agreement By and Between County of San <br /> Joaquin and Trimark Communities , or the "Agreement') is applicable to <br /> the development of all real properties in Mountain House in which Trimark <br /> Communities and its assignees have a legal or equitable interest. The <br /> applicable provision of the Agreement that relates to the project is Exhibit <br /> B-1—Existing Approvals, specifically Part II of Exhibit B-1: Vested <br /> Elements. <br /> The Vested Elements are approvals locked in for the duration of the <br /> Agreement. Included in these Vested Elements is Figure 3.5 of the Master <br /> Plan, which shows the location of land uses within the community on <br /> properties that Trimark Communities has a legal or equitable interest.
