PA-0400213 OF DAVID & PAMELA <br /> PAYNE (C/O MONTE SEIBEL) (APN: 051-180-18, 33, 34, 35, 36, 37) <br /> (ADDRESS: 17510 N. TRETHEWAY ROAD, LOCKEFORD) <br /> The applicant has submitted the above referenced Site Approval application for a private right-of- <br /> way to serve six parcels in the Small Farms Improvement Tract Division "Q" antiquated <br /> subdivision. The total acreage of the project is 20.0 acres with a Zoning designation of AG-40 <br /> (General Agriculture-minimum 40 acres) and a General Plan designation of A/G (General <br /> Agriculture). <br /> The project site is located on the east side of Tretheway Road, 1100 feet north of State Route 12, <br /> south of Lockeford. <br /> The Community Development Department has reviewed the proposed Site Approval and offers <br /> the following comments: <br /> Oak Tree <br /> The definition of a Heritage Oak Tree is a native oak tree that has a single trunk diameter of <br /> thirty-two (32) inches or greater measured at four and one-half (41/2) feet above the average <br /> ground elevation of the tree. (Development Title Section 9-110.4) By definition, the oak tree on <br /> Lot 2 is a Heritage Oak Tree. Development Title Section 9-1505.3 states that the removal of a <br /> Heritage Oak Tree shall not be permitted unless the Review Authority finds that one or more of <br /> the following situations exists: <br /> 1. The removal is in the public interest; <br /> 2. The tree interferes with an existing structure, utility service, or road, and no reasonable <br /> alternative exists to correct the interference other than removal of the tree; <br /> 3. The removal is necessitated because the tree is endangering another plant in the area <br /> with infection or infestation; <br /> 4. The removal is necessitated because the tree interferes with the maintenance of flood <br /> control facilities. <br /> I <br />
