The use is compatible with adjoining land uses <br /> i This finding',can be made because the proposed use will not interfere with nor alter the current <br /> land uses on adjacent properties.The properties surrounding the project site to the east,west <br /> and north ar"e also zoned AG-80 and are in active agriculture production.The property to the <br /> south is located within the City of Lathrop and has been zoned for residential uses. San <br /> Joaquin Cdunty Code Section 6-9004(3)states that the County of San Joaquin recognizes and <br /> supports the right to farm agricultural lands in a manner consistent with accepted customs, <br /> practices,and standards. Residents of property on or near agricultural land should be <br /> prepared to'accept the inconveniences or discomforts associated with agricultural operations <br /> or activities,:including but not limited to noise,odors, insects,fumes,dust,the operation of <br /> machinery of any kind during any kind during any twenty-four(24) hour period (including <br /> aircraft),the application by spraying or otherwise of chemical fertilizers,soil`amendments, <br /> seeds, herbicides, and pesticides,the storage of livestock feed and other agricultural <br /> commodities and the storage,application and disposal of manure..San Joaquin County has <br /> determined that inconveniences or discomforts associated with such agricultural operations <br /> or activities shall not be considered to be a nuisance. The nearest current residences to the <br /> proposed project site are approximately 3,000 feet to the west,% mile to the north, 3,800 feet <br /> to the south and 2,900 feet to the east.The proposed River Island development project is <br /> approximately 1.2 miles to the south across Old River which bisects the two properties. In a <br /> letter dated.-January 26, 2009,the River Island development group statr`that currently no <br /> homes have been built to date due to the slumping economy, but-all infrastructure and <br /> roads necessary for the first neighborhoods are in place, and they do intend to construct the <br /> neighborhoods when market conditions improve." <br /> Williamson Act Compatibility Principles: <br /> (1) The use will not significantly compromise the long-term productive agricultural capability of the subject <br /> contracted parcel on."Parcels or on other contracted lands in agricultural preserves. <br /> • This finding.can be made because the proposed use is for the production of food, and is an <br /> agricultural use as defined in the Williamson Act. The proposed project will not impact the long- <br /> term productive agricultural capability of other contracted lands in the agricultural preserves. <br /> (2)The use will not significantly displace or impair current or reasonably foreseeable agricultural <br /> operations on the subject contracted parcel or parcels or on other contracted lands in agricultural <br /> preserves. Uses that significantly displace agricultural operations on the subject contracted parcel or <br /> parcels may be deemed compatible if they relate directly to the production of commercial agricultural <br /> products on the subject contracted parcel or parcels or neighboring lands, including activities such as <br /> harvesting, processing, or shipping. <br /> • This finding can be made because the use will not significantly displace or impair current or <br /> reasonably foreseeable agricultural operations on the subject contracted parcel or parcels or on <br /> other contracted lands in agricultural preserves.The proposed use is for the raising of chickens <br /> for food on the'eontracted parcel. <br /> 3 <br /> (3)The use will not result in the significant removal of adjacent contracted land from agricultural or open- <br /> space use.
